It was decided by late 1995 to nearly double the cut in JDSF from 28.5 mmbft to 54 mmbft. The 1996 summer JDSF newsletter, in an attempt to prepare public opinion, stated that "somehow over the last 10 years, Jackson Demonstration State Forest fell behind a whole year's worth in sales volume."
BOF policy is that the annual allowable cut be averaged over only 5 yearsAncient Forests, Old Growth, Late Seral Forests
"Anticipated recruitment procedures for important wildlife habitat elements for listed species primarily associated with LSF stands" never occurs within the framework of THP, dismissing LSF continuity with statements that there are no LSF (Late Seral Stage Forest) stands proposed for harvest. "Considering the dire consequences of not reaching the targeted harvest volume, it is important to minimize the avoidable uncertainties in predicting the volumes. scheduled sales will yield. In addition, based on experiences in Caspar and Mushroom Corners, over the last two years, and in the absence of public participation in and but-off of our planning process, I have postponed sales with the potential for intense public controversy that might reduce the achievability of the anticipated volume."

On Weds., 8/23/95, CDF Employees Association and CDF signed a settlement agreement involving the Shepherd Fair Labor Standards Act lawsuit. A wage class lawsuit, filed 3/20/92 for the ruling class of CDF, cash for overtime. It was a 4.2 million dollar settlement, plus court costs. Money began to dry up for the FRIF accounts by 1992. A network of RPF's associated to numerous forested land parcels, each by the stewardship principles of implementing the projects defined in FRIF et. al.,
began to feel restricted by the lack of available funds.
Even CDF laments this shift of revenues. Ken Delfino discussed this with Vince Taylor, and myself, at a meeting in the spring of 1995. By then the Forest Restoration Improvement Fund (FRIF) was, for all purposes, closed, or rather, absolutely no funds were available. Not only was the FRIF being mis-appropriated, but so was the Environmental License Plate Fund. By the spring of 1995, CDF at a timber sale preparation meeting at Howard Forest, agreed that Region Office would provide a pre-review of & THP's & to avoid them being returned un-filed. "The extreme importance of meeting the timber sale schedule, limited the scope of the input of biological and watershed specialists on 1995-96 THP's to CWHR simulations of pre- and post-harvest habitat… based on scenarios developed by the RPF. LSF determinations to be made on the basis of inspections of candidate stands identified by RPF. This limited consultation can be most effectively accomplished by informal reports provided directly to the RPF."
